ORDER 1. We have seen circular dated 7-8-1989, on which reliance was placed by the respondent Food Corporation of India, pertaining to the class of workmen for whose kith and kin the employment on compassionate ground f is sought in this IA. The list of total workmen who died between 1975 and 1996 is at p.276 of the paper-book. Learned counsel for the appellant applicant agrees to prepare two lists out of the main general list. The first list shall be of those persons who have died between 1975 and 6-8-1989 and the second list shall be of those persons who have died on or after 7-8-1989 till 1996. These lists shall be furnished to the office of Food Corporation of India 9 at Calcutta which is monitoring the depot in question at Siliguri. Food Corporation of India will scrutinise the list of those persons who have died on or after 7-8-1989 and who would have got the benefit of the order of this Court dated 16-7-1996, but for their unfortunate death after 1989 and before 1996 and will scrutinize the claim of the kith and kin of the deceased workmen concerned as per the rules and regulations and the policy decision of 7-8-1989 as subsequently modified by two other policy decisions. So far as the first list is concerned further orders will be passed thereafter. 2. The lists to be furnished by the learned counsel for the appellant applicant shall be furnished to the Calcutta office of Food Corporation of India within two weeks from today. The Corporation, after scrutinising the second list, shall file a report in this connection within four weeks thereafter. 3.To be placed after six weeks. 4. We make it clear that this IA claims no relief against those persons who have survived in 1996 and whose claims for reinstatement are being scrutinised by Justice Banerjee pursuant to our order in IAs Nos. 6 and 7.
