Judgment 1. The petitioners, who claim to be Assistant Teachers of Primary School, Tulsiyani, Saharsa appointed by the then Managing Committee on 2nd September, 1970. The school was taken over with effect from 1.1.1971 in pursuance of Bihar Act 30 of 1976. 2. According to them, their services were approved by the Director, Primary Education, vide Memo No.2916 dated 20.11.1988 and they were provided with benefits. 3. Grievance has been, made that the salary of the petitioner was stopped since 20th February, 1990 on the ground that some sort of enquiry is being conducted at the level of Director, Primary Education. 4. It is alleged that in pursuance of order of Director dated 8th December, 1992, though salary of other similarly situated persons has been released and benefits granted to others in pursuance of orders passed in one or other writ petitions, petitioners have not been provided with such benefit. 5. The Respondents in their counter affidavit while accepted that some sort of enquiry is being conducted, merely stated that irregularities were committed in the matter of approval of services of teachers of taken over schools. 6. According to them, the enquiry is ongoing and the Director, Primary Education has passed order for release of salary of 60 teachers, whose cases were recommended earlier by the District Education Establishment Committee. 7. Similar case fell for consideration in the case of Sushil Kumar Pandey vs. State of Bihar and others C.W.J.C.No. 6328 of 1998). The said case was disposed of on 17th December, 1999 by a Bench of this Court with certain observations and directions. 8. Following the decision in the case of Sushil Kumar Pandey (supra), I also allow this writ petition with similar directions to regularise the salary of petitioner so that the same is being paid regularly, every month, in accordance with law, with further direction to pay all the dues, including arrears within six months from the date of receipt/production of a copy of this order. 9. The writ petition is allowed with aforesaid observations and directions.
