ORDER 1. Heard the parties. 2. The dispute in this writ petition relates to effective date of grant of freedom fighter's pension. The petitioner has been granted pension with effect from 20th April, 1992. According to him, he is entitled to it since 22nd July, 1981, the date when he submitted the application. 3. In the counter affidavit filed on behalf of Union of India, it has been stated that though petitioner did not file adequate proof in support of the claim, and, therefore, his claim was kept pending for some time, on review, he was given benefit of doubt and granted pension. It is stated that in view of decisions of the Supreme Court In the cases of U.O.I. and others v. Ganesh Chand Dolai and others (Civil Appeal No.1995 of 1995) and U.O.I. v. M.R. Chelliah Thevar (Civil Appeal No.7762 of 1996), where the pension is granted giving benefit of doubt, the pension is payable from the date of order and not from the date of application. Since the order granting pension was passed on 30th March, 1994, in my opinion, going strictly by the decisions of the apex Court aforesaid, it ought to have been made effective from that date and not from 20th April, 1992. 4. It will not be out of place to mention that the petitioner made his claim on the basis of two Certificates in respect of his underground suffering, granted by one Barhu Singh and Sahdeo Singh. No other document, such as, Jail Certificate and/or non-availability of court record certificate was produced. Since in such cases the Central Government usually insists upon production of such documents, I must observe, in the case of petitioner it was rather indulging in granting him pension giving benefit of doubt. I do hot wish to make any further observation which may adversely affect the case of the petitioner. 5. This writ petition stands dismissed.
