Specific allegation of assaulting the deceased by fire-arm is levied against the applicant. There is a cross-case in the incident however no injury is suffered by the applicant. Without expressing any opinion on the merits of the case, at this stage, there is a conflicting report by the prosecution as in one of the report it is alleged that the offence was committed by Meghsingh, whereas in another investigation it is found that offence is committed by the applicant. Since, the prosecution itself is not sure in respect of the person who has committed the offence, it is directed that the applicant-Balvirsingh be released on bail on furnishing personal bond in the sum of Rs. 50,000/- with two solvent sureties each in the like amount to the satisfaction of Chief Judicial Magistrate.
