(1) PURSUANT to the order dated 2 4/11/1999 affidavits of the Municipal Corporation, Delhi and the secretary Ministry of Urban Development, government of India have been filed with regard to Delhi. (2) WITH regard to Bangalore city, no affidavit has been filed either by the Commissioner or by the State of Karnataka. Learned counsel appearing for Bangalore Municipal Corporation states that on behalf of the Commissioner, affidavit will be filed today. Needful be done but because of the delay in filing affidavit, costs of Rs. 5,000.00 be deposited in the Registry by the next date of hearing. As far as the State of Karnataka is concerned, the affidavit be filed within four weeks from today and costs of Rs. 10,000.00 be also deposited in the Registry. (3) AS far as Mumbai city is concerned, no affidavit has been filed either by the Commissioner or by the State of Maharashtra. Learned counsel appearing for Bombay Municipal Corporation States that on behalf of the Commissioner, affidavit will befiled today. Needful be done but because of the delay in filing affidavit, costs of Rs. 5,000.00 be deposited in the Registry by the next date of hearing. As far as the State of maharashtra is concerned, the affidavit be filed within four weeks from today and costs of Rs. 10,000.00 be also deposited in the Registry. (4) WITH regard to Chennai city, the affidavits on behalf of the Commissioner, Chennai Municipal Corporation and the State Government of Tamil Nadu have been filed. Copies of the same be given to Mr. Dushyant Dave and to the other counsel. (5) AS far as Calcutta city is concerned, the Commissioner has not filed the affidavit but the affidavit on behalf of State of West Bengal has been filed. The Commissioner, Calcutta Municipal Corporation is directed to file the affidavit within four weeks from today and to pay Rs. 10,000.00 as costs. (6) ON behalf of the central Pollution Control Board, copy of the Report has been given to Mr. Dushyant Dave today and the same will be filed in court today. (7) ON behalf of the Union of India, it is indicated that the Management of Municipal Solid Waste (Management and Handling Rules, 1999 will be notified shortly. Hopefully it will be done by the next date of hearing: this is on the premise that the finalised Rules have not already been notified.

No. 4 of 1999 : This is an application for intervention filed by Kachara Vahatuk Shrarnik Sangh in which the prayer inter alia is that the system of employing contract labour on the work in Solid Waste Management Department should be discontinued by the Bombay Municipal Corporation. This is one of the points which will arise for consideration and decision by this court in this writ petition. Though the applicant has been put to notice with regard to this, it still desires to withdraw the application for intervention. The prayer for withdrawal ofl.A. is allowed making it clear that no representation thereafter will be entertained in this matter if the court decides to pass appropriate orders with regard to the employment or non-employment of contract labour in the work of solid waste management.
