Judgment 1. Heard the counsel for the petitioner and the State. 2. In view of order this Court intends to pass, it is not necessary to hear the 7th Respondent, Dr. Gopal Mishra at this stage. 3. The petitioner has been suspended vide impugned Memo No. 1340 dated 12th August, 1999 alleging violation of direction of superiors and for dereliction of duty in contemplation of such departmental proceeding. 4. Grievance has been made that no departmental proceeding has been initiated though the order was issued about ten months back on 12th August, 1999. 5. The counsel for the petitioner submitted that the main allegation was made against the Ex.lncharge Medical Officer, Dr. Gopal Mishra and the Additional Chief Medical Officer, Samastipur recommended for his suspension vide Memo No. 155 dated 11th August, 1999. Though the order of suspension has been issued in respect of petitioner, said Dr. Gopal Mishra has not yet been suspended. 6. The counsel appearing on behalf of the State submits that the matter will be looked into and appropriate order, in accordance with law, will be passed. 7. In the facts and circumstances, while I do not choose to interfere with the order for the present, in the interest of justice, pass the following orders. 8. The Respondents are directed to take a decision relating to initiation of departmental proceeding. If they so choose, they will initiate proceeding and issue charge sheet and serve the same on petitioner by 11th August, 2000. If no charge sheet is issued and served on petitioner by 11th August, 2000 in such case, the order of suspension will stand revoked with effect from 12th August, 2000. 9. On the other hand, if charge sheet is issued and served on petitioner by 11th August, 2000, they will hold enquiry and conclude the same by passing final order therein within nine months from the date of issuance of such charge sheet. In such case, the petitioner should co-operate in the departmental proceeding failing which the authorities will proceed ex parte, in accordance with law. 10. If the proceeding in such case is not concluded and final order is not passed within the aforesaid nine months period, in that case also, the order of suspension shall stand revoked on completion of such nine months period. 11. So far as other person, Dr. Gopal Mishra is concerned, the petitioner may bring the same to the notice of the Director-in-Chief, Health Services, who will decide as to whether to act on the recommendation dated 11th August, 1999 for suspension of said Dr. Gopal Mishra and for proceeding against him or not. 12.
