JUDGMENT 1. - We have heard Mr. M.C. Bhoot, learned counsel for the appellants. Learned counsel has brought to our notice a decision of Division Bench of this Court in Chhaju Ram v. Jag Ram & Ors., reported in 1997 (2) WLC 438 in support of the contention that his Court has power to re-appreciate the evidence, exercising powers under section 18 of the Rajasthan High Court Ordinance. We have read the judgment. It is held therein that when there is a concurrent finding of fact, this Court will be extremely slow to interfere with the finding of fact. It is only in the rare case that the concurrent finding of fact should be disturbed. The learned Single Judge on re-appreciation of oral and documentary evidence and on consideration of relevant law has confirmed the finding of fact arrived at by the trial Court decreeing the suit for possession. Mr. Bhoot has failed to persuade us to interfere with the concurrent finding of fact arrived at by the trial Court and confirmed by the learned Single Judge. We do not find any good and valid reason to interfere with the judgment under appeal. 2. Consequently, the special appeal is dismissed in limine.Appeal rejected. *******
