Judgment 1. This application has been preferred by the petitioner for direction on the Respondents to pay him the salary of the post of Senior Mechanic having promoted to the said post on 12th June, 1982 and the subsequent order of reversion/demotion having set aside by this court. 2. The brief fact of the case shows that the petitioner was initially appointed as Helper, was promoted as Senior Mechanic in the then scale of Rs. 680-965/- vide one Order No. 104 dated 12th July, 1982. On such promotion, while he was functioning against higher post, order of promotion was cancelled and he was reverted to the post of Helper by order dated 28th February, 1984. 3. The aforesaid order of reversion was challenged by petitioner along with another in C.W.J.C.No.1444/84 wherein this Court after hearing the parties, set aside the order of reversion, vide judgment and order dated 4th September, 1986. 4. The grievance of the petitioner is that the Respondents in spite of such order passed by this Court setting aside the order of reversion, have not paid the petitioner salary of the promotional post of Senior Mechanic, though he is still continuing against such higher post. 5. The Respondents in their counter affidavit have taken plea that after the decision of the Court, the case of the petitioner was reconsidered and the earlier order of promotion having ound illegal, the same was cancelled and petitioner was reverted, to his substantive post of Electrician, vide Memo No. 2032 dated 24th December, 1986. 6. The counsel for the petitioner submits that he had no knowledge of the said order dated 24th December, 1986 till date, having not served on him. 7. In the facts and circumstances, while I am not inclined to direct the Respondents to pay salary of the higher post of Senior Mechanic for the period from 24th December, 1986 onwards, he having earlier promoted; worked, and the order of reversion having set aside, I declare that the petitioner is entitled for salary of such higher post of Senior Mechanic for the period from 4th December, 1984, including the period he stood reverted and his case remained pending before this Court.
If the salary of the period from 4th February, 1984 to 23rd December 1986 in the higher grade of Senior Mechanic has not yet been paid to the petitioner, it must be paid after adjustment of amount already paid, within three months from the date of receipt/production of a copy of this order. 8. However, this order will not stand in the way of the petitioner to challenge the order dated 24th December, 1986 before the competent authority/court of law, if the same was earlier not served on him. 9. The writ petition stands disposed of with the aforesaid observations and directions.
