JUDGMENT 1. - Petitioner is seeking appointment to the post of Sub-Inspector, Police, in pursuance to selection, made by the Rajasthan Public Service Commission (hereinafter to be referred as the Commission). Though the name of the petitioner has already been recommended by the Commission, however, the appointment was denied to the petitioner on the ground of medical report, in as much as, the petitioner lacks the requisite height by 1 cm. for the post referred above. 2. Petitioner made a representation for constituting a fresh Medical Board. However, the representation was rejected vide order dated 23.10.1999. to The orders dated 6.7.1999 and 23.10.1999 are under challenge in the present writ petition. 3. This court, while issuing notices to the respondents, also directed the Superintendent, SMS Hospital, Jaipur, to constitute a Medical Board and the petitioner was directed to appear before the Medical Board for examination of his height. 4. The Medical Board, duly constituted as per directions of this court, has submitted its report dated 2.5.2000. As per report of the Medical Board, the height of the petitioner comes to 168 Cr.P.C., which is the minimum required height for the post in question. The Board, constituted as per direction of this court, consisted of three eminent specialists from different departments of the SMS Medical College, Jaipur, as such, there is nothing to disbelieve the report of the subsequent Medical Board. 5. Since no other infirmity has been shown or alleged against the petitioner, in my opinion, the petitioner is entitled for appointment to the post of Sub-Inspector of Police, as per merit recommended by the Commission to the State Government. 6. Accordingly, writ petition is allowed. Respondent Nos. 1 and 2 are to directed to issue appointment letter to the petitioner as per his merit. Since the training has already started, the letter of appointment be issued within three days from the receipt of certified copy of this order.
