JUDGMENT R.S. Garg, Actg. C.J.- Applicant has been arrested in connection with Crime No. 202/2000, registered at Police Station Kawardha, for offence punishable under Section 306, I.P.C. 2. Prosecution allegations are that the present applicant R. 1, Coach of deceased Nasima Sheikh wanted to exploit the said girl and for that reason only he was asking her to over stay even after the game was over. According to the prosecution, because of the pressure and the intention of the present applicant, the girl committed suicide. Unfortunately, a serious dent is given to the prosecution story by its own witnesses who have clearly stated in their case diary statements that the deceased had some intimacy with the present applicant, had gone to some places with the present applicant and because of the intimacy she over-stayed after the game was over. 3. Taking into consideration totality of the circumstances and the character of the evidence so far as collected by the prosecution in support of the case, I consider present to be fit case for admitting the applicant to bail. Application is allowed. 4. On applicants furnishing a personal bond in sum of Rs. 7.000/- with one surety in the like amount to the satisfaction of the Chief Judicial Magistrate, Kawardha, he shall be immediately released for his appearance before the said Court/Committal Court trial Court or as and where so directed. Application allowed.
