In section 175 the circumstance under which cause of action for a suit by the State under this dection arises on execution of the document and on entering into possession of such holding in pursuance of that document. The limitation for this type of suit is prescribed under schedule III. The words used in schedule III are the date of transfer or sublease. This provision does not envisage that the fact should come to the knowledge of the State for starting the point of limitation. There is no provision in law where for a suit under Section 175 the State can claim limitation frame the date of knowledge. Wherein the intention of the law is that the limitation should start from the date of knowledge such a provision has been made in the law of limitation for that purpose there is no provision in the Limitation Act either where the State can claim exemption till thedate of knowledge for a suit under Section 175.
