Judgment 1. This petition has been filed as a public interest litigation. The petitioner contends that he is a social worker and he is espousing the cause of the members of the area in question. The area is erstwhile area consisting of villages Ghoghardiha, Deordh and Kishnipatti and this area was notified as Ghoghardiha notified area. 2. The contention is that this area ought to have been included as a Panchayat and not as a Nagar Panchayat. Reference is being made to the entry at item no. 49 in the notification dated 30 August 2001 appended to the petition. If the petitioner accepts that the area was a notified area then unless there are any special circumstances, logically the area would be made a Nagar Panchayat. 3. The elections to the Panchayats are over. The court is not going into any issue which has been raised by the petitioner for the simple reason that after about three decades the State of Bihar is now witnessing a self government with the elections to the Panchayats having been held recently and elections to the Municipalities are engaging the attention of the State government and the State Election Commission. Now is not the time to raise issues which may have the effect of stalling elections and if the choice is between returning of elected representatives to the Panchayats and the Nagar Panchayats and having self government at the levei of Panchayats and the Municipalities the court would rather see self government come into being than permit an issue to be raised which any complicate the situation. 4. Thus, this petition is dismissed.
