JUDGMENT C.J. and P.C. Verma, J.: Heard Sri Arvind Kr. Sharma, learned counsel for the petitioner. 2. According to him in view of the decision laid down in Raj Deo Sharma v. State of Bihar, 1998 J.Cr.C. 689 (SC); AIR 1998 SC 3281, the prosecution which is prolong since 1992 can not be sustained. Learned counsel for the State Sri U. K. Uniyal, however could not successfully resist the submission. In view of this the petition is allowed and the prosecution is hereby quashed.
