JUDGMENT K.S. Garewal, J. - The petitioner is alleged to be one of the conspirators with his son Rajiv and one Ashok in the murder of Tek Ram. Allegation is that Tek Ram had illicit relation with Ashoks mother and the conspiracy was hatched on July 1, 2001, overheard by Krishan. The petitioner had said to Ashok and Rajiv that Tek Ram had illicit relations with Ashoks mother, Ashok and Rajiv should finish him off and he will take care of the Court and the police. Later, the same night at about 12.30 a.m. Karamvir had seen Ashok and Rajiv entering Tek Rams house and later coming out of the house. Tek Ram was found dead next morning with his throat sliting. The main accused in this case are Ashok and Rajiv. Sukhbir Singhs role is allegedly of a conspirator. It would be for the trial court to determine the part played by the petitioner. The circumstances do not warrant further detention in custody. 2. Bail to the satisfaction of Chief Judicial Magistrate, Sonepat. Petition allowed.
