With the consent of the parties, this petition is disposed of finally. Petitioner has applied for taking up the examination of LL.B. (Final) in the University/Respondent No. 1. Application form of the petitioner has been cancelled on the ground that M.P. State Bar Council has stopped the facility of permission to appear in LLB. Examination to all private candidates including women candidates. Petitioner has challenged the order (Annexure P-I). The petitioner has also categorically stated that petitioner does not wish to practice as an advocate. In return, the respondent/University has stated that in the light of the letter received from the State Bar Council of M.P., the petitioner's form has been rejected and the University has permitted regular candidate only. On perusal, of letter (Annexure R-1), it is apparent that it has been requested to University for scrapping this provision allowing the private candidates to appear in the LLB. Examination degree course to the students whether male or female. The University is unable to point out that in pursuance of the aforesaid letter, the University has taken any steps for scrapping the provisions allowing the women candidates to appear in the LL.B. Examination as private candidate. In absence of any amendment to the Rules, Ordinance of the University, the petitioner's form could not be. rejected. In the return, the respondent/University has not mentioned that in pursuance of the letter received from the M.P. State Bar Council, steps were taken and Rules for LLB. Examination have been amended whereby the private candidates including the women candidates are not permitted to appear in the examination. Petition, therefore, succeeds and is allowed. The order (Annexure P-1) is quashed and respondent/University is directed to issue examination form to the petitioner. Copy of the order be sent to the M.P. State Bar Council.
