JUDGMENT P. C. Verma, J. : Heard the learned counsel for the applicants and learned A.G.M. 2. The applicants are facing prosecution for an offence under Section 302/ 34 of the I.P.C. According to the applicants, they have been falsely implicated, as it that shown in the F.I.R. no occurrence took place which is evident from the post mortem report. The post mortem report shows that rigor mortis passed over from all the four limbs and is found only on the neck. According to mod, this could be only after two to three days, in temperate regions. In view of the post mortem report, the death could have occurred much more before the occurrence. However, it is a matter to be seen in the trial. 3. Considering the facts and circumstances of the case the applicants Khim Singh, Tara Singh and Ranjeet Singh be released on bail in Case Crime no. 1 of 2001 under Section 302/34 I.P.C., Patwari circle Dhaungarh, Distt, Almora on furnishing by each of them a personal bond with adequate sureties each in the like amount to the satisfaction of C. J. M. Almora.
