ORDER Karl Reddy, F. C. - This is a petition under Section 16 of the Punjab Land Revenue Act, 1887 seeking to revise the order dated 11.11.1999 of the Commissioner (Appeals), Jalandhar Division, Jalandhar whereby he set aside the order dated 4.8.1997 of the Assistant Collector IInd, Grade, Gurdaspur and the order dated 20.1.1998 of the Collector Gurdaspur, in proceedings for correction of Khasra Girdawari for harvest from Kharif 1993 onwards in respect of land comprised in Khasra No. 16//7(8-0) as per Jamabandi for 1992-93, situated in the revenue estate of Paniar, Had Bast No. 313, Tehsil Gurdaspur. 2. Milkhi Ram etc. claim to have been allotted the land in dispute by the Collector Agrarian, Gurdaspur in 1974, being tenants on the surplus area of a big landowner, and to be in cultivating possession thereafter as owners. The Assistant Collector IInd Grade held Des Raj etc. to be in cultivating possession at the time of his spot inspection, notwithstanding the allotment by the Collector Agrarian, Gurdaspur in favour of the opposing party. In appeal, the Collector declined to interfere. The Commissioner (Appeals), relying on the order dated 12.6.1996 of the Additional Civil Judge (Senior Division), Gurdaspur, and the assumption of continuity of possession, reversed the orders of the two lower Revenue Officers. Hence the present petition. 3. The judgment of the Additional Civil Judge, Senior Division, Gurdaspur in Civil Suit No. 27 of 1996, Date of Institution 12.1.1996, Date of Decision 29.8.2000 has been placed on file. Milkhi Ram etc. respondents have been able to establish their ownership over the disputed land but have been unable to establish their possession, notwithstanding the Jamabandi entries for 1977-78 and 1992-93 in their favour. The Jamabandi entries for 1997-98 stand in favour of Des Raj etc. Consequently, they have been held to be in possession of the disputed land, but not in the capacity of tenants as claimed. Consequently the revision petition is accepted. Announced. Petition accepted.
