JUDGMENT : 1. The review petition would not survive and stands disposed of. 2. However, the following order dated 4th May, 2001 passed in the review petition is to be treated as passed in the Writ Petition No. 13381 of 1984: “Heard learned counsel for the parties. Perused the affidavit filed by Dr. SD Makhijani, Additional Director, CPCB, Delhi and our order dated 7th November, 2000. In the affidavit it has been pointed that for complying with the said order budgetary provisions are required to be made either by the State Government or by the Central Government. For the purpose of the budget provisions amount as under is required to be provided: (a) Hardware for Monitoring Station Total Costs Rs. 47,40,000/- (b) Hardware for Central Laboratory Total Cost Rs. 23,73,000/- (c) Operational Costs Rs. 49,45,000/- In all the total costs is Rs. 1,20,50,000/- It has been submitted on behalf of the State of UP that full cost of hardware for Monitoring Stations and hardware for Central Laboratory, would be provided by the Mission Management Board within four weeks from today after due verification. With regard to the remaining amount of operational costs of Rs. 49.45 lacs, the funds would be made available by the Central Government, to the CPCB within four weeks from today after verification. The CPCB shall use those funds for the purpose for which they are provided as stated above.” 3. The Commissioner, Agra Division, Agra is directed to inspect and coordinate in complying with the various orders passed by this Court from time to time. He is directed to wile the report on or before 27.7.2001 and thereafter he will submit periodical reports every two months with regard to the actions taken to comply with the orders.
