JUDGMENT 1. - The respondent No. 1 -Rajasthan Public Service Commission (for short 'RPSC') issued an advertisement on 1.7.1997 for filling up the posts of Assistant Agriculture Research Officer (Horticulture). The vacancies declared in the advertisement were 5, out of them 3 were reserved for General Category, 1 for SC and 1: for ST and 1 post was reserved for Woman among General category candidate. The petitioner submitted his application for the post of Assistant Agriculture Research Officer (Horticulture). The petitioner was asked to appear before the RPSC for verification of the documents for settlement of the merit list on 26.12.1997. On 12.1.1998 RPSC issued a letter informing the petitioner that his name stands at S.No. 1 in the reserve list. On 30.12.1997 the RPSC declared the merit list of 5 candidates; 3 for general category 1 for SC and 1 for ST. By letter dated 12.1.1998 the petitioner was informed that his name stands at S.No. 1 in the reserve, list. 2. During the continuation of the selection process on 20.11.1997, the s Department of Personnel, Government of Rajasthan, issued a circular that the existing 100% point vacancy based roster shall be replaced by post-based rosters. All the Administrative Departments and the Head of Departments/ Appointing Authorities are requested to prepare the respective rosters based on the principles elaborated in the explanatory notes given in Annexure-1 of this circular-order and illustrated in the modern rosters annexed to this circular as Annex. II and Ill. The annexure which is in relation to the direct recruitment, the roster of S.No. 1 to 4 was fixed for unreserved category candidates, S.No. 5 is fixed for Other Backward Category. Clause 9 of the circular says that these orders shall taken effect form the date of their issue. 5 However, where selections have already been finalised they need not be disturbed and the necessary adjustments in such cases may be made in future. In other cases, recruitment may be with-held till the revised rosters, are brought into operation and recruitment effected in accordance with these instructions. 3. Thus, under the circular if the recruitment is not completed, new roster shall be applicable, according to which 4 posts have to be filled in from unreserved category candidates whereas 5th posts has to be filled in from OBC category candidate. 4.

The advertisement having been issued for 5 posts and selections 5 having not finalised according to the model roster system applied by the Government from 20.11.1997, 4 posts of Assistant Agriculture Research Officer (Horticulture) have to be filled in from general category candidates. 5. Accordingly, it is directed that the respondent shall reply the model roster.... system for giving appointment on 5 posts of Assistant Agriculture Research Officer (Horticulture). Two candidates have already been given appointment. The exercise shall be made for giving appointment applying the model roster system on three posts in pursuance of the advertisement dated 1.7.1997. The aforesaid exercise shall be done within a period of one month from the placement of this order before the appropriate authority.The writ petition stands disposed of.Writ Petition Disposed of as above. *******
