JUDGMENT 1. - Learned Public prosecutor is directed to accept notice. Accordingly, he accepts notice. At the joint request of the parties, this petition is finally disposed of today. 2. The main grievance of the petitioners is that in F.I.R. No. 244/99 police investigated the case filed negative final report on which the learned trial court took cognizance for offences under Sections 498A and 304B I.PC. against the petitioners. The accused petitioners have been summoned by non- bailable warrants. On behalf of the petitioners a request was made to the learned trial court to supply them the certified copy of all the documents which has been filed by the police under Section 173 Cr.PC. The learned trial Magistrate vide order impugned refused to make available the certified copies of the papers filed by the police under Section 173 Cr.PC. From the order impugned, it appears that no reason has been assigned for not issuing the certified copies. Learned Counsel for the petitioners submits that the petitioners are prepared to bear expenses for the copies as provided in General Rules (Criminal), 1980. Section 190 of the General Rules (Criminal), 1980 reads as under:- "Rule 190:- Who can obtain copies in Criminal proceedings: (i) Parties to a criminal proceedings are entitled to obtain copies of any portion of the record or trial or enquiry including such police papers as may be used as evidence at the evidence or including as F.R. submitted by the police under Section 173 of the Code." 3. I find no valid and substantial reason for denying the accused petitioners of the certified copies, specially when they are prepared to bear expenses for copying. The learned Public Prosecutor failed to controvert the contentions raised by the learned counsel for the petitioners. In this view of the matter, the order impugned cannot be sustained and is liable to be quashed. 4. Accordingly, this petition is allowed and the order dated 3.9.2001 is quashed and the Additional Chief Judicial Magistrate (Communal Riots). Pali is directed to make available the certified copies of the papers filed by the police under Section 173 on an application by the petitioners. The petitioners will bear requisite expenses for copying.Petition allowed. *******
