Judgment J. C. VERMA, J. ( 1 ) HEARD learned counsel for the parties and perused the material made available to me on record. ( 2 ) THIS is a second application for bail filed under Section 438. Cr. P. C. for anticipatory bail in FIR No. 127/2001 registered at Police Station. Reengus Distt Sikar against the accused applicants for committing the offence under Sections 147, 148, 149, 307, 323, 447 and 341, IPC. The first application for anticipatory bail filed under Section 438. Cr. P. C. was dismissed by this Court on 07/08/2001 and the order of the trial Court rejecting the bail application moved before him was confirmed. ( 3 ) IT is unfortunate to know that despite the anticipatory bail having been rejected the 1. 0. concerned, or the Investigating Agency did not take any interest, to apprehend the accused applicants. The Prosecuting Agency is supposed to satisfy the Court about the investigation conducted by the Investigating Agency or by the 1. 0. concerned. ( 4 ) AFTER hearing learned counsel for the parties and perusing the material on record, I do not find any ground to release the accused applicant on anticipatory bail. The bail application is, therefore, dismissed. ( 5 ) TIME and again, it is being noticed by this court that the Investigating Officers are not performing their duties properly in maintaining, the law. I have already directed the Registry of this Court to send such orders to the Director, General of Police. Rajasthan, Jaipur, for taking appropriate action in the matter, against the I. Os. Let a copy of this order be sent to the DGP for taking action in the matter against the 1. 0. concerned, as to why the accused applicants could not be arrested when their applications for bail were rejected by the trial Court as well as by this Court. The DGP, as, therefore, directed to appear in person before this Court on 24/9/2001 at 2. 00 p. m. to explain about the conduct of the 1. 0. and will submit his report to this Court as to what efforts were made for the arrest of the accused applicants by the 1. 0. concerned. Let a copy of this order be given to learned P. P. today. To come up on 24/9/2001. Application dismissed. .
