ORDER : 1. The short question that arises in this case is whether the appellant herein, whose land is acquired, is entitled to interest on a sum payable under Sub-section 1 (a) of Section 23 of the Land Acquisition Act, 1894. The Constitution Bench of this Court in the case of Sunder v. Union of India, 2001 (6) SCALE 405 has held that the claimant is entitled to interest under Sub-section 1 (a) of Section 23 of the Land Acquisition Act. 2. Following the above said decision, the judgment under challenge is set aside to that extent and the appeal is allowed. There shall be no order as to costs.
