JUDGMENT P. C. Verma, J. : Heard learned counsel for the .petitioner as well as learned Chief Standing counsel. 2. The learned Chief Standing counsel very frankly submitted that the case of the petitioner shall be considered in accordance with the Proviso appended to Rule 5 of Dying-in-Harness Rules, 1974. 2. In view of this submission the writ petition is disposed of with the direction that the respondents shall consider the case of the petitioner in accordance with the provisions of Rule 5 of Dying-in-Harness Rules 1974 ignoring the rejection order.
