JUDGMENT 1. - These two bail applications have been moved separately by accused Ram Charan and Smt. Kalawati. The accused Ramcharan has been arrested under Section 8/21 and 8/29 of the N.D.P.S. Act. 2. The facts as narrated in the FIR are that on 5.1.2001, the officers of the Narcotics Department stopped a bus bearing No. RJ 17-P/0140 and made a search. The accused Ram Chand was travelling in the bus and the co-accused Smt. Kalawati was also travelling in the same bus. According to the prosecution story Smt. Kalawati was searched and 600 grams heroin was recovered from her, which was found tied on her private parts. The story of the prosecution is that both the accused-persons were in league and Smt. Kalawati was as a matter of fact, hired by accused Ramcharan to work as a carrier to transport the contraband. The basis of this conclusion is that both the bus tickets were found with accused Ramcharan and hence the conclusion that both the accused-persons were guilty of the offences as stated above. 3. After hearing of the arguments, I find that the accused Ramcharan has not been charged under Section 8/2 of the N.D.P.S. Act and has been charged under Section 8/29 of the N.D.P.S. Act. I am of the view that for the sake of argument, even if it is believed that both the tickets were found with the accused Ramcharan, it does not establish conclusively that the accused Ramcharan had the knowledge about the contraband. 4. Without expressing any opinion in further details, in the facts and circumstances of the case, I am inclined to admit the accused Ramcharan to bail. According his bail application is allowed and direct to enlarge the applicant Ramcharan s/o Mangilal on bail provided he furnishes a personal bond in the sum of Rs. 50,000/- with two sureties of Rs. 25,000/- each to the satisfaction of the court concerned. 5. The co-accused Kalawati was actually carrying 600 grams heroin on her person and her bail application is dismissed.Bail allowed to one and refused to other accused. *******
