JUDGMENT 1. - Learned counsel for the respondent prays for time to file the reply to the petition. However, I do not find any justification in this prayer made by the respondent's counsel. The prayer made by the counsel for the respondents is declined. 2. Challenge is made by the petitioner to the order dated 5.9.2001 under which the petitioner's name was deleted from the list of the registered publishers and further it was black listed. This order has been passed as per case of the petitioner without notice and opportunity of hearing to him. Leaving apart the question whether the order aforestated is passed without notice and opportunity of hearing to the petitioner or not but it is a cryptic order and it cannot be allowed to stand. It is a serious matter i.e. striking of the name of the petitioner as a registered publisher of the Board and further to black list him is a reasoned order is to be passed in the matter rather than to feel satisfied by this non-speaking order.As a result of the aforesaid discussion this petition succeeds and same is allowed and order dated 5.9.2001 is quashed and set aside. The Secretary of the Board is directed to decide the matter afresh after giving the notice and opportunity of hearing to the petitioner and if he decides to decide the matter against the petitioner a reasoned order be passed. This exercise has to be completed within a period of one month from the date of receipt of this order.Petition allowed. *******
