JUDGMENT 1. - Since the controversy involved in all the writ petitions is same, therefore, all the writ petitions are decided by this common order. 2. The Director, Medical & Health Services, Rajasthan, Jaipur, issued an advertisement dated 4.9.99 inviting applications from female candidates for training course of Female Health Workers. The petitioners were issued call letters and they appeared before respondent No. 3-Chief Medical & Health Officer, Ajmer. A Selection Committee was constituted for selecting the candidates. The Selection Committee selected petitioners for the training. Petitioners joined the training which was of one and a half years duration. It was subsequently found that the OBC, SC and ST candidates who were more meritorious than the petitioners have not been adjusted in the list of general category candidates and therefore, an order was issued dated 3.6.2000 removing 15 candidates from training as after joining of the SC, ST and OBC candidates the number of seats exceeded the quota fixed for general category candidates. 3. Being aggrieved by the aforesaid order petitioners have filed the present writ petitions. This court by an interim order granted stay of the operation of the order dated 3.6.2000. As a result of the interim order granted by this court petitioners continued with the training and have also cleared semester examination. It is submitted by the learned counsel for the petitioners that as a matter of fact certain candidates of general category have not joined the training and therefore, the petitioners could have been adjusted by issuance of a subsequent list of general category candidates to the extent the selected general category candidates have not joined the training. Neither the counsel for petitioners nor the counsel for the respondents are in a position to make a categorical statement as to how many candidates from the general category have not joined the training. 4. Under these circumstances, it would be appropriate for the respondents to find out as to how many candidates of general category have not joined the training and adjust those number of the candidates who have not joined the training by giving admission to the petitioners for training in accordance with their merit. 4. Under these circumstances, it would be appropriate for the respondents to find out as to how many candidates of general category have not joined the training and adjust those number of the candidates who have not joined the training by giving admission to the petitioners for training in accordance with their merit. It shall also be open for the respondents to consider the fact that as a result of the interim order of the court the petitioners have practically completed the training and if they can be accommodated for the training, to pass an order in that regard. Ordered accordingly. 5. With the aforesaid directions the writ petitions stand disposed of.Writ Petition Disposed of as above. *******
