ORDER : 1. Leave granted. 2. Heard learned counsel for the parties. 3. It is not necessary to enter into the merits of the contention. After perusing the impugned order and going through the facts and circumstances of this case, we feel it appropriate and accordingly order to set aside the order passed by the High Court and send back the case to the High Court for deciding the same in accordance with law. The Chief Justice of the High Court will list this matter before an appropriate court at early date after this order is received by the High Court. 4. The appeals are, accordingly, disposed of.
