JUDGMENT : L. Mohapatra, J. - Heard the learned Counsel for the Petitioners and learned Addl. Govt. Advocate. 2. The application u/s 482 Code of Criminal Procedure has been filed for quashing the proceeding in G.R. Case No. 626 of 1998 pending in the Court of learned S.D.J.M., Kendrapara. 3. As it appears from the record, on the basis of the F.I.R. lodged by Petitioner No. 2, the aforesaid G.R. Case had been registered and cognizance has been taken on 19.5.1999 for the offence u/s 376/511, I.P.C. The application has been filed by the informant and the accused-petitioner No. 1. It is stated in the petition that both of them have married and are now living happily and they do not want to proceed with the aforesaid G.R.case any further. This petition is supported by affidavits of both the informant and the accused Petitioner No. 1. 4. In view of what has been stated in the petition and the submission of the learned Counsel for the Petitioners, lam of the view that no (ruitful purpose would be served in allowing the aforesaid G.R.case to continue and continuance of the same may affect the happy married life of both the Petitioners. Accordingly, I quash the proceeding in G.R. Case No. 626 of 1998 pending in the court of learned S.D.J.M., Kendrapara. 5. Crl. Misc. Case is accordingly allowed. 6. Urgent certified copy be granted on proper application. Final Result : Allowed
