JUDGMENT P.C. Verma and M. C. Jain, JJ. 1. The grievance of the petitioner in this writ petition is that even after negotiation, the petitioner has not been given work order for the work to be executed by him for the Public Works Department. 2. The negotiation further took place between the petitioner and the Superintending Engineer, P.W.D., Pithoragarh. The Superintending Engineer asked the petitioner for the execution of work, if the petitioner was ready to work at the estimated cost. 3. After this negotiation, a fresh tender has been issued. It appears that the said negotiation was not acceptable to the higher authorities than that of Superintending Engineer. Therefore, the Superintending Engineer has again issued tender notice. Now in view of the fresh negotiation for the tender, it is open for the petitioner to participate in the process and if his bid is accepted, he will work. Therefore, the grievance of the petitioner is misconceived. 4. The writ petition is dismissed accordingly.
