RAJESH KUMAR SINGHAL v. STATE OF DELHI

2001-02-20

R.C.CHOPRA

body2001
R. C. Chopra ( 1 ) HEARD. In the FIR there was no allegation whatsoever against the petitioner regarding assault or injury to the complainant. It appears that subsequently a supplementary statement was recorded in which it was alleged that the petitioner had snatched some money from the complainant. In the absence of these allegations in the FIR, the supplementary statement cannot be safely relied upon especially for the reasons that the dispute between the parties appears to be on account of possession of some property. ( 2 ) CONSIDERING the facts and circumstances of the case and nature of the allegations against the present petitioner, I am of the considered view that it is a fit case for grant of anticipatory bail to him. The petitioner has been joining investigations. The application is allowed and the petitioner is ordered to be released on bail upon his executing a personal bond in the sum of Rs. 15,000. 00 with one surety in the like amount to the satisfaction of the Arresting Officer. The petitioner shall, however, continue to join investigations as and when required. Dasti. Anticipatory Bail allowed.
