JUDGMENT 1. - The petitioner is involved in two criminal cases of gruesome murders of three persons including murder of SHO Sheopat Singh who was on duty. 2. Benefit of proviso to section 437(1) Cr.P.C. was not given to the petitioner and her earlier bail petitions were dismissed. Instant second bail petitions have been filed on the ground that there is no body to properly look after her two small children as entire family is in judicial custody. 3. Hon'ble Mr. Justice P.N. Bhagwati speaking for the Bench of three Hon'ble Judges of the Apex Court in Lakshmi Kant Pandey v. U.O.I. (1984) 2 SCC 244 indicated that every child has a right to love and be loved and to grow up in atmosphere of love and affection and of moral and material security and this is possible only if the child is brought up in a family. 4. I am also of the view that the future well being of the Nation depends on how its children grow and develop. The Great Poet Milton was right when he said : "Child shows the man as morning shows the day." 5. After having heard rival submissions advanced before me and on a close scrutiny of the documents placed before me I am prima facie satisfied that children of the petitioner are brought up in a congenial environment of their joint family. 6. I do not find any merit in the instant bail petitions, they are accordingly dismissed.Bail Rejected. *******
