JUDGMENT : B.P. Das, J. - This application u/s 438 Code of Criminal Procedure has been filed for grant of anticipatory bail for the offence alleged to have been committed under the Essential Commodities Act. Learned Counsel for the Petitioner cited a decision reported in Dinesh Kumar Dubey and another Vs. State of M.P., wherein the Court has held that the offence, under the Essential Commodities Act are cognizable and bailable as per the amended Section 10-A of the 1955 Act. Since the offence is said to be bailable one, the application u/s 438, CI.P.C. is not maintainable. I, therefore, dismiss the application as not maintainable. Final Result : Dismissed
