ORDER S.J. Mukhopadhaya, J. 1. The petitioner claims to be posted as Assistant Director, Planing, Ranchi under the Animal Husbandry and Fisheries Deptt. of State of Jharkhand. 2. It is alleged that the Respondents have not released the salary for the period from 1.10.1996 to 3.12.1997, as the petitioner was not given any posting after closure of the earlier scheme. 3. Having regard to the facts and circumstances, the petitioner is given liberty to represent the Secretary-cum-Commissioner, Animal Husbandry Department. Jharkhand, Ranchi showing therein details of posting as were made prior to 1st October, 1996 and after 3rd December, 1997. 4. The Secretary, in his turn, will en-quire the matter and pass appropriate order within two months from the date of receipt of such representation. If the file is not available in the State of Jharkhand, the Secretary will request its counter-part at Patna to forward the file who, in his turn, will send the detailed documents within a month from the date of such requisition. In such case, a decision be taken and communicated to the petitioner within four months from the date of receipt of representation. 5. On such decision, if any amount is found payable, the same be paid in favour of petitioner, on an early date, but not later than six months from the date of receipt of such representation. 6. It is made clear that if the petitioner could not perform duty awaiting posting and/ or the scheme having lapsed, the Respondents will be liable to pay full salary for such period. 7. The petitioner will produce a copy each of this order along with representations before both the Secretaries of the concerned Department i.e. State of Jharkhand and State of Bihar. 8. The writ petition stands disposed of with the aforesaid observations and directions. 9. Petition disposed of.
