ORDER : 1. Leave granted. 2. Heard the learned counsel for the appellants and Mr. Deshpande appearing for the Special Land Acquisition Officer, State of Maharashtra. A batch of similar cases came up before this Court in Civil Appeal No. 11809/1995 and batch, which were disposed of after condoning the delay and remitting to the Commissioner for re-consideration in view of certain circulars of the State Government excluding a particular category of land from acquisition. Since the present case is squarely covered by the aforesaid direction of this Court, we condone the delay and dispose of in terms of the directions contained in the aforesaid Civil Appeal. Needless to mention that in the event the appellants succeed in getting exclusion of any part of the land acquired, then the compensation amount determined already would be pro-rata reduced. The appellants are directed to produce the relevant documents within 4 weeks from today. We were not inclined to remit this matter but Mr. Deshpande says that the earlier batch of cases are still pending enquiry and therefore we follow it. 3. The appeals are disposed of.
