Short Note The defendant-petitioners filed an application under Order 9 Rule 13 of CPC to set aside the judgment and decree passed against them. They raised certain grounds for their non-appearance in the suit. That application was contested by the plaintiff-respondent. During the pendency of the said application, an application under section 151, CPC Document No.F was filed praying that additional grounds as mentioned therein be permitted to be incorporated in the application under Order 9 Rule 13 CPC. By the impugned order, the learned trial Court has rejected the said prayer. It appears that the learned lower Court has considered the grounds raised under section 151, CPC and has made certain observations regarding the acceptability of the said grounds. However, the above approach does not appear to be proper. The defendant-petitioners are praying for setting aside the judgment and decree and by the application Document No. F they had sought permission to raise an additional ground. At the stage of consideration of the said application merits of the said averments ought not to have been considered. The said application was infact in the nature of amendment to the original application under Order 9 Rule 13 CPC. The defendant-petitioner could be permitted to raise additional ground as was prayed by him by his application Document No. F. However, permitting the defendant-petitioner to do so would not by itself mean that the ground is to be accepted or disallowed. It is obvious that, such a ground after being permitted to be incorporated in the original application under Order 9 Rule 13 of CPC will have to be considered on merits. In the circumstances, the revision is allowed. The impugned order rejecting the application under section 151 of CPC Document No.F is set aside and the said application is allowed. The defendant/petitioner shall be permitted to incorporate the additional ground as was prayed by him. The plaintiff-respondent will be afforded an opportunity to make consequential amendment in its reply. Thereafter, the trial Court shall proceed to decide the application under Order 9 Rule 13 of CPC keeping in view the observations as above.
