ORDER : 1. Substitution allowed. Leave granted. Heard learned counsel for the parties. 2. The present appeal is directed as against the order dated 23rd July, 1996 passed in L.P.A. by the High Court. The said LPA was dismissed on the ground of delay and even on merits. The matter has not been considered by the High Court merits except stating that one line. 3. We feel, in the interest of justice, the matter may be decided on merit. The aforesaid impugned order of the High Court is accordingly quashed. The case is remanded back to the High Court for deciding in accordance with law after giving opportunity to the parties. Accordingly, the appeal is allowed. Costs on the parties.
