Judgment 1. Union of India has filed the present petition resisting the order dated 18.12.2000 of the Central Administrative Tribunal that the admitted gratuity be paid to the respondent. 2. On contention it is submitted that the gratuity cannot be paid on account of certain disciplinary or criminal proceedings which may be pending. The court notices that in paragraph - 5 it has been recorded that even the memoranda of charges have not been served on the respondent. 3. In the circumstances, the court feels that the Tribunal has not committed any error in giving the direction. 4. Thus, the petition is dismissed.
