( 1 ) THE petitioner has questioned the correctness and legality of the order of cancellation of his appointment, vide order dated 14/12/1989. The effect of the suspension order was suspended. This Court, while granting the stay of suspension on 27/02/1990, clarified that it was open for the respondents to pass a fresh order granting opportunity to the petitioner. Even after more than eleven years, the respondents have not availed the liberty as granted. The petitioner, in terms of the interim order, is continuing in the employment. In view of this, we set aside the impugned order of cancellation. The petitioner shall continue in the employment as is continuing in terms of the interim order dated 27/02/1990.
