JUDGMENT 1. - Heard the learned counsel for the accused applicants, Shri Gajanand Yadav as well as the learned Public prosecutor, Shri Rajendra Yadav assisted by Shri M.K. Kaushik. 2. Perused the material placed before me, including the post-mortem report. 3. According to the post-mortem report of medical board, the mode of death of Suresh Kumar is asphyxia. The cause of asphyxia could not be ascertained by the medical board and it is opined that after receipt of chemical examiner's report, it can be said that what is cause of asphyxia, which resulted in death of deceased Suresh Kumar. 4. It is urged by the learned counsel for the accused applicants that challan papers has been submitted by the prosecution agency within 90 days before the court, without furnishing a copy of the chemical examiner's report to ascertain the cause of asphyxia. 5. It is submitted by the learned counsel for the accused applicants that although it is allowed by the prosecution agency that deceased died due to poisoning, but in absence of FSL report the charge sheer submitted by the prosecution agency cannot be said to be complete. 6. The cause of death of deceased, which can be proved by scientific data from the chemical examiner's report cannot be proved by oral evidence recorded under Section 161 Cr.RC. 7. Without exploring the merit of the case, I am persuaded to enlarge the accused applicants on bail. 8. It is, therefore, ordered that the accused applicants Nos. 1. Smt. Imarti Devi wife of Bholaram and No. 2 Smt. Mera Devi widow of Suresh Kumar, be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of like amount to the satisfaction of the learned trial court for their appearance before the said court during the pendency of trial against them in this case.Bail granted to both the applicants. *******
