ORDER A news report of today about the post Panchayat elections circumstances is disturbing. The Panchayats today take their sanctity under the Constitution of India, so also the elected representatives returned to their offices. They are by right and under the Constitution entitled to take charge of the position to which they have been elected Court relating to Panchyats 2001 (2) BBCJ la Vs. State of Bihar forthwith. No issue can be made about this. A news item which has appeared today (19.7.2001) in the daiiy "Hindustan Times" mentions that as a generality a class of the Block Development Officers have denied to hand over the cash books to the newly elected representatives of the Panchayats. The time for the officials and the bureaucracy to run the Panchayats is over. The elected representatives have come in and the charge of the Panchayats now belongs to the elected representatives and delivering charge to them should neither be made an issue nor delayed. On the news item the court has indicated to the State counsel Mr. Alamdar Hussain, S.C.6., that he will taken instructions and reported to the court next week on Monday (23.7.2001).
