R. S. GARG, J. ( 1 ) HEARD. Case-Diary of Crime No. 2/2001 of Police Station Gole-Bazar, Raipur for offences punishable under Section 457/380, I. P. C. perused. ( 2 ) THIS order shall dispose of M. Cr. C. No. 957 of 2001 (Devendra Nath Dubey v. The State of Chhattisgarh) and M. Cr. C. No. 1048/2001 (Sunil Soni v. The State of Chhattisgarh. ( 3 ) TRUE it is that the theft relates to a sum of Rs. 2,78,000/- and odds but the fact cannot be lost sight of that almost Rs. 2,15,000/- has already been recovered and each of the applicant is in jail for last five months. ( 4 ) TAKING into consideration, pre-trial detention of each of the applicant and that the offences are triable by Magistrate First Class. I consider present to be fit cases for admitting each of the applicant to bail. The applications are allowed. ( 5 ) EACH of the applicant be released on bail on his furnishing a personal bond in sum of Rs. 10,000/ - with one local surety in the like amount to the satisfaction of the C. J. M. Raipur for his appearance before the said Court/committal Court/trial Court or as and where so directed. ( 6 ) THE applicants are forewarned that if they do not appear before the said Court/trial Court on the date/ dates which are given to them by the said Court then the said Court shall be entitled to cancel the bail, forfeit the bonds, recover the money and take them back to custody.
