ORDER S.J. Mukhopadhaya, J. 1. This application has been preferred by petitioner for direction on respondent-General Manager-Cum-Chief Engineer, Area Electricity Board, Dhnabad to accept the draft amount of Rs. 70.000/-which the petitioner intends to deposit and to accept the rest of the amount in instalment, so far as it relates to fuel surcharge and current charge. 2. According to counsel for the petitioner the energy bill for Electrical consumption of Rs. 1.19.423/- has been received by him out of which the petitioner intended to deposit a sum of Rs. 70.000/- by a draft but respondent have not accepted the same. It will be deposited, if the respondents accept, within 48 hours and rest of amount within two months. 3. So far as fuel surcharge is concerned, the petitioner has requested to direct the authorities to accept the total amount in five equal monthly instalments. 4. Having regards to the facts and circumstances, on hearing the parties, taking into consideration the interest of both the parties, the writ petition is disposed of with the following directions. 5. The petitioner will deposit a sum of Rs. 70,000/- towards current energy bill by 17th September, 2001 and the rest of the, amount of Rs. 46.423/- by 16th November, 2001 and the petitioner is allowed to deposit the total amount in five equal monthly instalments- The first instalment is to be paid by 30th September, 2001 and the rest amount in four monthly instalments to be paid by the last week of the subsequent months. 6. If the petitioner approaches the Electrical Superintending Engineer Dhanbad, he will handover the details of the bills in question within fifteen days thereof. 7. If the draft for Rs. 70.000/- is deposited on or before 17th September. 2001, the concerned officer will restore the electrical connection within 72 hours. 8. In case the petitioner fails to deposit any of the instalment as fixed above and/or fails to deposit any other dues like current charge of other period etc. it will be open to the respondents to take coercive steps against the petitioner. 9. Writ disposed of with directions.
