JUDGMENT : 1. In certain arbitration proceedings an application was filed before the High Court by the third party to the proceedings, however, he remained ex- parte in the proceedings before the High Court. The High Court had granted an interim order and stayed the proceedings before the Arbitrator. We do not find as to what reasons impelled the High Court to grant the interim order much less are we able to discern the grounds upon which the said third party had approached the High Court for the relief in those proceedings. Therefore, we think it appropriate to set aside the order made by the High Court on 17.2.1994 granting stay of the proceedings before the Arbitrator. The appeal is disposed of accordingly. 2. Having heard learned counsel on both the sides and after going through the petition, we are satisfied that this is a fit case in which the proceedings titled Abdul Karim Dar v. M/s Vishnu Kumar Gupta & Ors. pending before the High Court of Jammu and Kashmir at Srinagar in Arbitration Petition No. 52/1994(CMP No. 14/1994) be transferred to the Bench available at Jammu. 3. T.P. is disposed of accordingly.
