ORDER The Court 1. As the matter relates to payment of death-cum-retiral benefits, and requires determination by the respondents. at first instance, the case is disposed of at the stage of admission. 2. According to petitioner, her husband late Gabriel Toppo was in the services of the Electricity Board and died in harness on 17.2.1995 while posted in the Urban Electric Sub-Division No. 1. Ranchi. 3. It is stated that the respondents though paid a sum of Rs. 10.000/- towards Group Insurance and the daughter of the petitioner has been given employment on compassionate ground, the rest of the benefits like G.P.F.. gratuity, arrears of pension and leave encashment have not been paid, though the Bihar State Electricity Board issued two orders of sanction on 17.11.95 and 10.11.95 in respect to G.P.F. and gratuity respectively. 4. Counsel for the Jharkhand State Electricity Board submitted that the husband of the petitioner having died in the year 1995, it is for the Bihar State Electricity Board to decide the issue. 5. In the circumstances, the petitioner is given liberty to bring the matter to the notice of the Bihar State Electricity Board through its Secretary. The authority of the Bihar Stale Electricity Board will decide the claim and pay the admitted dues, if any within three months from the date of receipt of representation. 6. On failure Bihar State Electricity Board will be liable to pay 5% interest. 7. On the other hand, if the respondents dispute any claim/part thereof, will forward the ground to the petitioner within the aforesaid period of three months. 8. The writ petition stands disposed of with the aforesaid observation and direction. 9. Petition disposed of accordingly.
