Short Note I Heard the learned counsel for the applicant-appellant as well as the learned Govt. Advocate representing the respondent-state. Perused the record. The case against the accused-applicant is based on circumstantial evidence. The contention is that the Trial Court has failed to take into consideration the missing links which have material bearing. Taking into consideration the facts and circumstances as brought on record, sufficient ground has been ma de out for the release of the applicant on bail during the pendency of the appeal subject to the following conditions: (1) He shall furnish a personal bond in the sum of Rs. 50,000/- (Rupees fifty thousand only) with two solvent sureties of Rs. 25,000/- each to the satisfaction of the CJM Shivpuri, undertaking for his appearance before the Registrar of this Court on 18th October 2001 and on such other dates which may be fixed. (2) During the period of release on bail the accused-applicant will not repeat offence and will maintain peace and good behaviour in his village with his neighbours; and (3) He will not leave the jurisdiction of this Court unless permitted to do so.
