S. K. Agarwal ( 1 ) FOR the purpose of convenience, the Union of India shall hereafter be referred to as the "petitioner" and the Students Islamic Movement of India and the respective state Government as "respondents". ( 2 ) LEARNED Additional Solicitor General, Mr. K. K. Sud submits that service in terms of order dated 20th October, 2001 has been effected and seeks time to file affidavit of service during the course of the day. Let the needful be done. ( 3 ) MR. Rakesh Munjal, Senior Advocate submits that he has received instructions to appear on behalf of Students Islamic Movement of India (for short simi ) and all its branches. He submits that the two applications moved by him may be heard and disposed of today. Let copies of these applications be supplied to counsel for Union of India. ( 4 ) LETTERS received from the individuals be numbered and Copies of each of them be supplied to counsel for the petitioner and respondent No. 1, ( 5 ) LIST for further hearing on 8th December, 2001 at 11. 30 A. M. IA. (T ). 2/2001 ( 6 ) BY this application, respondents have prayed for suitable directions to the Superintendent, Central Jail, Tihar to permit Mr. Shahid Badar, President, SIMI, who is stated to be lodged in Central Jail, Tihar, to sign the written statement and other documents to enable them to file the same in the Tribunal. Itis argued that the Superintendent, Central Jail, Tihar, despite request, permitted the signatures only on the Vakalatnama which has been placed on record. The application is duly supported by an affidavit. Learned ASG for Union of India rightly did not oppose the application. ( 7 ) UNDER the circumstances, Superintendent, Central Jail, Tihar is directed, in terms of the Jail rules, to permit the Advocate for respondent No. 1, SIMI, to have legal interview with Mr. Shaid Badar, President, SIMI and allow to to put his signatures on the written statement and other documents to be filed with the Tribunal. Let the written statement along with the supporting documents be filed within three days. Ten additional sets of the written statement and documents be placed at the disposal of the Registrar of Tribunal, which may be collected by the counsel for the States. Replication, if any, be filed before the next date of hearing.
