ORDER Heard learned counsel for both the parties. This civil revision application has been preferred against the order dated 28.7.2000 passed by Munsif, Patna City, in Misc. Case No. 10/92 whereby the prayer made on behalf of the petitioner for summoning the official witnesses has been rejected. The petition was filed on 3.6.2000 on which date evidence on behalf of the petitioner was closed. But instead of passing any order on the petition filed on behalf of the petitioner the evidence was closed and the matter was kept opened to be decided on the next date. On 28.2000 the Learned court has observed that when the evidence of the petitioner has already been closed and no petition was filed for re-opening of his evidence, then there is no scope to entertain the petition tiled on behalf of the petitioner. The learned court below did not apply his judicial mind in perusing the record. On 3.5.2000 when it was fixed for hearing, a petition was filled for summoning the official witnesses and that petition was kept pending for orders on the next date. But on the next date the impugned order has been passed which is in contradiction to the order passed earlier. In that way, the impugned order dated 28.7.2000 is hereby quashed and the matter is sent back to the court below who shall dispose of the same in accordance with law.
