In this writ application the petitioner has prayed for issuance of writ of mandamus directing the respondents to pay the petitioner, the minimum of pay scale prescribed for regularly appointed lecturer as the petitioner has been doing same work as compared to regularly appointed lecturers. 3. Petitioner's case is that he was appointed as temporary part time lecturer in the year 1995 on payment of consolidated amount of Rs.1300/- per month. It is stated by the petitioner that he is taking four to six classes per day regularly but he is getting Rs.1300/- per month as salary, although regular appointed lecturers have been taking two-three classes per day are getting pay scale of Rs. 6500/- to 10,500/-. The respondents in their counter-affidavit have stated that other similarly situated lecturers have approached the High Court for the same relief but the relief of getting regular pay scale was not granted. 4. Mr. N.N. Tiwari. learned counsel for the petitioner mainly put heavy reliance on the decision of the Supreme Court in the case of "Vijay Kumar vs. State of Punjab" [ AIR 1994 SC 265 ] and submitted that part time lecturers who are (sic-not?) gainfully employed elsewhere are entitled to get at least minimum pay scale prescribed for regular appointed lecturers. 5. The averments made by the petitioner in the writ application is that he has been taking four to six classes per day regularly since 1995 but he is not getting wages at par with the regularly appointed lecturers who are not even taking four to six classes per day regularly. This fact has not been denied or disputed by the respondents. This Court is of the view that petitioner is not entitled to be regularised in service as regular lecturers but so long he continues to work as lecturer, he is entitled to get minimum pay scale prescribed for the regular appointed lecturers. This Court is further of the view that this is high time when the respondents should initiate process for appointing the regular lecturer. In the event respondent advertise the post, the petitioner will be entitled to apply for the said post. Petitioner shall be entitled to relaxation in age and his past experience as part time lecturer shall also to be considered by the appointing authority. 6. With the aforesaid observation and direction this writ application is disposed of.
