Judgment Nure Alam Chowdhury, J. This application under section 482 of the Code of Criminal Procedure on behalf of the petitioners Pronoy Kishore Dutta & Sunita Dutta is directed for quashing of the proceeding being B.G.R. case No. 5148/88 pending before the ld. 3rd Judicial Magistrate, Alipore, South 24 Parganas arising out of Sonarpur P.S. case No. 19(9)88 under sections 419/468/471/34 I.P.C. and all orders passed therein including the order dated 23.3.99 & 16.11.99. 2. Heard the ld. Advocates for the parties. Perused the records. 3. It appears from records that charge-sheet was submitted in the case on 20.7.91 and on 16.11.99 charge under sections 419/468/471/34 I.P.C. was framed against the accused petitioners after hearing the parties at length and on consideration that there are sufficient materials to frame charge against the petitioners before this court for framing the charges as above. It also appears from the annexed orders-sheet of the ld. Magistrate that the petitioner also played a role for delay in disposal of the case before the ld. Magistrate. 4. In the aforesaid facts and circumstances, this court does not find any justifiable ground to quash the impugned proceeding at this stage. 5. The instant application heard as a can tested application then fails and stands dismissed and disposed of and the interim order of stay passed by this court an the application stands vacated. 6. Let a copy of this order be sent dawn to the court below forthwith far further proceeding in the case as there has been considerable delay already far final disposal of the case. Appeal dismissed. Interim order vacated.
