JUDGMENT 1. Heard learned counsel for the petitioner and learned public prosecutor for the State and perused the case diary so also the site plan. Prima-facie from the perusal of the site plan it does not appear that the incident occurred in the public view, more particularly when there is no allegation about anybody else being there in any of the adjoining fields. 2. Prima-facie in the circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly the bail application is allowed and it is directed that in the event of the petitioner Durga Singh being arrested in connection with FIR Case No. 64/99 of P.S. Shahpura, he shall be released on bail on his furnishing a personal bond in the sum of Rs. 10,000/- alongwith two sureties of Rs. 5,000/- each to the satisfaction of the investigating officer during investigation, inquiry and trial, if any, on the following conditions : (i) That the petitioner shall make himself available for interrogation by a police officer as and when required and shall also appear during enquiry, or trial if any : and whenever and wherever called upon to appear; (ii) That the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer; and (iii) That the petitioners shall not leave India without previous permission of the Court.
